Terms and conditions: This promotional competition is organised by “Makro” which refers to Masstores (Pty) Limited, trading as Makro SA (registration number: 1991/006805/07) and Namaqua. The competition commences on 1 March 2011 and ends on 30 April 2011 (being the earliest and the latest dates for entries into the competition respectively) ("the competition period"). All Makro customers are eligible to enter the competition provided that – They are natural persons over the age of 18; they are citizens of South Africa in possession of a South African ID book; their complete, accurate and up to date name, contact telephone number and South African identity number are captured and appear on the Makro SAP Customer Relationship Management system ("SAP CRM system"); and their identification has been verified through their South African identity book; and they are not a director, member, partner, employee or agent of, or consultant to Makro or Namaqua or any other person who directly or indirectly controls or is controlled by the promoter/s or suppliers of goods or services in connection with that competition, or the spouse, life partner, parent, child, brother, sister, business partner or associate of such a person. For the purpose of these terms and conditions, “customer” means the natural person whose name, contact telephone number and South African Identity number are reflected on the Makro SAP CRM system at the time of the draw and whose Makro card is used to purchase any Namaqua 3L or 5L box wine. Entry into the competition will be automatic, using the customer details and actual purchasing data on the SAP CRM system. Customers will receive an entry into the draw when they purchase a Namaqua 3L or 5L box wine from any Makro store. 14 winners (one per Makro store) will each win a Sinotec 47 inch LCD TV valued at R7999. The winner/s will be randomly selected from eligible entrants for the relevant period, in the presence of an independent representative from Makro finance. Purchasing data will be based on the net sales of customers excluding Vat, after returns have been deducted. Subject to these terms and conditions, the person/s whose Makro card number is drawn and whose details appear on the SAP CRM system against that card number, will be the winner of the prize, provided that such person was eligible to enter into the competition. It is the customer's responsibility to ensure that their personal contact details captured on the SAP CRM system are complete, accurate and up to date. The winner/s of the prize/s will be notified by Makro by means of the contact details on the SAP CRM system recorded against the selected card number. Once the winner/s have been contacted, their details will then be published on the Makro website. If the contact number on the SAP CRM system does not exist or does not belong to the chosen winner/s, a new winner will be redrawn immediately. If the winner/s contact number/s are engaged, just rings or goes to voicemail, Makro reserves the right to re-draw a new winner within 5 working days. The winner/s of the prize/s must collect their prize/s from a Makro store, at a time arranged with the Makro representative, within one month of being notified, failing which they will forfeit the prizes, and in which event, Makro reserves the right to re-draw a new winner under the same conditions.. To the extent that a licence or permission is required in order to accept or use a prize (e.g. a drivers licence) the winner must produce such licence or permission for inspection by Makro prior to receiving the prize. If the winner is unable to do so, the winner will be disqualified and will forfeit the prize. In this event, Makro reserves the right to re-draw a new winner under the same conditions. The value of the prize includes Vat, and the goods will be given to the winner at the ruling price which is available to any customer on the day that they are rung up at the till. In order to be eligible to win a prize, customers must not have issued dishonoured cheques, or have overdue payments due to Makro at the time of the draw. Any costs or expenses incurred in respect of items not specifically included in the prize/s are for the winner’s own account. Makro and it’s associates if applicable will not be responsible for any other expenses which the winner/s may incur as a result of their acceptance and/ or use of a prize, whether foreseen or not. The prize/s are/ is not transferrable and may not be deferred, changed or exchanged for cash or any other item. To the extent that any taxes, duties, levies or other charges may be levied on a prize by the State or any other competent government or regulatory body, the winner/s will be liable therefore, and Makro will not increase the value of the prize/s to compensate for such charges. The winner/s agree/s to the publication of their name and image in the print and electronic media, and to appear in person on radio and/or television, if Makro so requests, and agree, within reason, to endorse, promote or advertise Makro's goods or services, for which no fee will be payable. Makro reserves the right to vary, postpone, suspend, or cancel the competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which Makro reasonably deems necessary. In the event of a dispute, the decision of the competition judges is final and binding and no correspondence will be entered into. If the winner/s fail/s to comply with any of these terms and conditions or the terms of acceptance of the prizes, or if they refuse to sign the Makro winners declaration or the Makro winners prize acceptance form, the refusal to sign will be construed as a rejection of the prize and then, without prejudice to any other remedy which Makro and its associates may have, the winner will be automatically disqualified and will forfeit the prize. | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
