terms and conditions: 1. The promotion runs from 30 August 2010 to 15 October 2010. 2. The competition is open to all Makro access card holders who are the residents of the Republic of South Africa except the employees of Brandhouse Beverages (Pty) Ltd (Brandhouse) trading as Brandhouse and the respective advertising, media and PR Agencies, as well as the family member, consultants, directors, associates and trading partner of such organizations and persons. 3. All entrants must be over the age of 18 years at the date of entry. Winners will be required to exhibit valid identity documents as proof thereof. 4. The participants must purchase a 750ml bottle of Captain Morgan Black Label from the participating Makro stores at the recommended price in order to be entered into the prize draw and stand a chance of winning a trip with one travel companion to Hemingway’s in Kenya. The winner and the travel companion must be able to travel between 19 November 2010 and 28 November 2010 and must procure their own travel insurance, valid passports and visas. 5. The prize will include return economy class flights, hotel transfers and accommodation. The winner and the travel companion will be responsible for their spending money. 6. All the Makro access card holders will be entered automatically in the prize draw by the store when they make the purchase in terms of 3 above. The winner will be electronically drawn at random by Makro head office on the 18 October 2010. 7. The winner will be notified telephonically and the prize will be collected at the store where the purchase was made. The prize will be forfeited if it is not collected within 7 days of the draw. 8. By entering the prize draw, all participants accept and agree to abide by the rules, terms and conditions that apply. 9. Prize is non-transferable, and may not be exchanged for cash. 10. The decision as to the winner is final and no correspondence will be entered into. The promoter reserves the right to substitute the prize with any other prize of comparable commercial value. 11. Neither Brandhouse Beverages (Pty) Ltd. trading as Brandhouse and their respective advertising, media and PR agencies, nor their trading partners shall be liable in any way whatsoever for any loss, damage or costs, howsoever arising, suffered by an entrant of this prize draw and or participant in the prize offered. 12. The promoter reserves the right to terminate or temporarily suspend this promotion in the event of technical or other difficulties that might compromise its integrity. 13. The promoter and their agents accept no responsibility for difficulties experienced in submitting an entry to this promotion. 14. Under no circumstances shall the promoter be liable to anyone who enters this competition for any direct or consequential loss howsoever arising which may be suffered in relation to the prize draw, whether as a result of any negligent act or omission or any default on the part of the promoter or otherwise. 15. The winner may be required to take part in publicity and participation in the prize draw is conditional upon agreement to take part in such publicity. Winner will not be entitled to any payment or other remuneration for any such publicity or otherwise. All and any materials, including publicity materials, will be the sole property of the Promoter. 16. The laws of the Republic of South Africa govern these Terms and Conditions and participants agree to be subject to the exclusive jurisdiction of the South African courts.
