LG Electronics Life’s Good Celebration Competition Terms & Conditions


The following information outlines the Terms and Conditions of entry into the LG Life’s Good Celebration Competition (“Competition”) run by LG Electronics South Africa and Masstores (Pty) Limited, trading as Makro SA registration number: 1991/006805/07) (“Makro”)  (“the Promoters”). The Terms and Conditions of the Competition are hosted on the LG Electronics South Africa website (https://www.lg.com/za) and on the Makro website (https://www.makro.co.za) and are subject to South African law. Entry into the Competition constitutes acceptance of these Terms and Conditions.

Competition Ts & Cs:

1.    This Competition is organised by the Promoters and is open to all persons of 18 (eighteen) years or older, in possession of a valid Identity Document (“natural person”) and permanently resident in South Africa. Any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoters and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter/s, their advertising agencies, advisers, dealers, suppliers, service providers, its affiliates and/or associated companies are not eligible to participate in this Competition.

2.    The entrant must be in possession of a valid South African identity document. Where the winner is a permanent resident, a valid passport and residential permit must be presented in order to be awarded the prize. The entrant cannot be a juristic entity and must be an individual.  

3.    The Competition rules, details, and/or Competition Period may be amended by the Promoter, at any time during the Competition. The Promoter reserves the right to alter, amend, suspend or cancel this Competition in its entirety and/or substitute or exchange the prize/value. In the event of an amendment, alteration and/or cancellation the Promoter will not compensate any individual for any reason whatsoever. The rules and/or any amendments thereto will be interpreted by the Promoter only.

4.    Competition Period: The duration of the Competition is from 18 May 2022 to 03 July 2022. Any entries received after the close of the Makro store’s operating hours 07h00 – 18h00 will be invalid and will not be considered. Online purchases made after 23h59 on the last day of 03 July 2022 will not be considered and all entries are subject to government regulations.

5.    To participate and stand a chance to win various LG prizes with a collective retail value of up to R500,000.00 (five hundred thousand rand), participants must purchase any LG product from participating Makro physical Stores or Makro online website or from any other participating retailer and enter by sending an image of their receipt/ proof of purchase via WhatsApp to +27 (0) 76 592 2166 and follow the prompts. Entries will be forfeited should participants return their LG product purchased. 
NOTE:  The WhatsApp line is controlled by the Promoter’s agency, Grammar Group (Pty) Ltd, all data collected from this line will only be used for the Competition and not be shared with any other agencies.

6.    Winners & Prizes: There will be a total of 39 (thirty-nine) prize winners with selected winners per the categories below.  Prizes will be awarded based on the value of the product purchased. Prizes per price category are as follows :

7.    In the case where the winner is awarded a TV, a valid and paid up TV license will be required to claim the prize. In the event that the winner does not have a TV license or the TV license is in arrears, the winner will have 30 (thirty) days from date of notification of being a winner to rectify the TV license and claim the package.  If the winner does not rectify the TV license within the foregoing timeframe, they will forfeit the entire prize package and the entire prize will be redrawn.

8.    Winner Selection: Winners will be categorised based on their purchases per the categories set out above and selected by random draw by an independent attorney verifying the competition. Only eligible entries will be considered. The lucky draw will take place approximately 30 days after the closing of the Competition, the estimated date being 29 July 2022. 

9.    Winner Notification: Winners will be notified directly by Promoter by means of SMS, WhatsApp, as well as phone call.  

10.    In the event that a selected winner(s) does not respond within 7 working days of the initial WhatsApp, SMS, or phone call sent by the Promoter, the prize will be redrawn and awarded to the runner(s) up. In such instance the new recipient will be considered the ‘winner’ and all these rules will apply to such substitute/runner up winner as well.

11.    By entering the Competition, the participant acknowledges that he/she is entering a promotional competition for the purposes of the Consumer Protection Act 68 of 2008 (hereinafter referred to as “CPA”) and the Competition will be conducted in accordance with the CPA. The winner of the Competition undertakes to do all things necessary to enable the Promoter and/or Retailer to comply with its obligations under the CPA including, but not limited to providing any personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and signing receipt of the prize upon its collection. Failure to produce sufficient evidence as to identity may result in disqualification, at Promoter’s sole discretion

12.    Prize redemption will be finalised with each winner on making contact with the winner post winner verification. The prize will be delivered to the winners. Winners will have to allow at least 14 (fourteen) working days for delivery of the prize. 

13.    In the event that Promoter’s agent attempts to make delivery to any winner at a time, date and place specified and agreed with by the winner and such winner is not there to take delivery of the prize, and has failed to inform Promoter’s agent, the prize will be forfeited by such winner unless agreed otherwise with the Promoter. 

14.    The prize(s) cannot be exchanged for an alternate prize, transferred or refunded for its cash value for any reason whatsoever.

15.    No late or incomplete entries will be considered.

16.    No person may win more than 1 (one) prize in this Competition.

17.    No responsibility is accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of transmission, posting or sending will not be accepted as proof of receipt.

18.    The Promoter reserves the right to disqualify entries which it considers, in its sole discretion, to not comply with the Terms and Conditions or any participant who it reasonably believes has interfered with the fair running of this Competition.

19.    In the event of a dispute, the decision of the Promoter’s is final, and binding and no correspondence will be entered into.

20.    The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of a participant.

21.    The Promoters may use personal information, supplied voluntarily by the participant, for marketing purposes for their other products and campaigns/promotions, which marketing purposes you may decline thereafter.

22.    By entering this Competition, the participant consents to the collection and processing of his or her personal information (including personal information contained in electronic communications) by the Promoters for the purposes of conducting this Competition and facilitating the participants’ participation in the Competition. Any personal information relating to the winner or an entrant will be used solely in accordance with the CPA and POPIA and will not be disclosed to a third party without your prior consent. By participating in the Competition, you consent to the sharing your personal information between the Promoters and its affiliates including holding and subsidiary companies.

23.    Except where prohibited by law or objected to by the individual at any time, each winner grants permission for the Promoters, and those acting under their authority, to use his or her name, and or photographs, and or voice for purposes of announcing the winners for this Competition and related advertising purposes, in any form of media and without additional compensation, notification or permission. 

24.    By posting any content, images, or comments on any of the Promoter’s public and/or social media platform or by sending any such content to the Promoter, a participant consents to and gives the Promoter a world-wide royalty-free licence to reproduce or modify such content, images, or comments. The participant hereby consents to the Promoter and/or Retailer supplying the participant’s personal information and contact details to any third party service provider to assist with the administration of the Competition as well as to contact the entrant for providing the results of the Competition and to arrange delivery to the winners of the prizes.

25.    The Results reflecting the winners name, card number and town/city will be published on the Promoters’ website and other media. The winner will be required to sign an acknowledgement of receipt of prize and may be requested to be photographed and/or identified in any media, which is inclusive of but not limited to television, radio print publications and online sites in which the Competition receives exposure and for future marketing initiatives with the understanding that the winner may decline such an invitation.

26.    The Promoter and Promoter’s agency, Grammar Group (Pty) Ltd, will not share any participant personal information with any third party except where such disclosure is necessary to enable the Promoter to provide, deliver or in any other way give effect to these rules and/or the prize(s), where such disclosure is required by law or where consent to Promoter sharing your personal information is obtained from participant(s) in advance.

27.    Participants can choose to opt-out of receiving communication from the Promoters, at any time, by responding to Promoter and/or Retailer on the communication received.

28.    The Promoter and/or Retailer may make media announcements / publications of the names / photographs of participant/s, save for where any participant/s expressly elect to decline this.

29.    Promoter reserves the right to carry out audits in respect of any participant/s to verify their eligibility and that of entry.

30.    Entries will become the property of the Promoter (including all intellectual property rights in the entry) and will not be returned.

31.    Participants are prohibited from submitting entries that are in the reasonable discretion of the Promoter unlawful, obscene, pornographic, libellous, defamatory, threatening, or other material that would violate any law, code of ethics, regulation or code of responsible advertising, or may be considered as generally irresponsible or anything that may compromise the Promoter’s reputation or legal position. If such entries are submitted, it will be considered invalid and will be disqualified.

32.    By entering the Competition, the participant automatically confirms that he/she has personally purchased the LG product from a participating Makro. Should this be found not to be the case, the participant shall forfeit their entry.

33.    In the event that a winner(s), for whatsoever reason, is unable to receive the prize, utilise the prize for whatsoever reason the winner will forfeit the entire prize. There will be no compensation, in any form, (including, but not limited to monetary compensation, irrespective of the reason(s) for inability of the winner to receive the prize.)

34.    All participants indemnify Promoters, its directors, officers, employees, representatives, agents, and its associated companies (and their directors, officers, employees, representatives and agents), against any / all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from their participation in any way howsoever in this Competition.

35.    All ownership and risk shall pass to the winning participant on receipt of the prize. The Promoter shall not be held liable for any defects or damage occurring after the transfer of ownership to the winning participant. Nor will the Promoter be liable for any costs incurred by the winning participant related to the prize after the transfer of ownership thereof. 

36.    Any costs or expenses incurred in respect of items not specifically included in the prize/s are for the winner’s own account. The Promoter’s and its affiliates, will not be responsible for any other expenses which the winner/s may incur as a result of their acceptance and/ or use of a prize, whether foreseen or not. 

37.    To the extent that any taxes, duties, levies or other charges may be levied on a prize by the State or any other competent government or regulatory body, the winner/s will be liable therefore, and the Promoter/s will not increase the value of the prize/s to compensate for such charges.  

38.    The value of the prize includes VAT, and the prize will be given to the winner at the ruling price which is available to any Participant on the day that the Participant makes the purchase. 

39.    Where the prize is a Makro gift card or voucher, if the gift card or voucher is misplaced or lost and subsequently used by someone other than the winner, the Promoter/s will not replace the gift card or voucher and the winner will bear such loss. These gift cards or vouchers will be subject to all the normal terms and conditions relating to the usage of gift cards in Makro stores, which can be obtained from www.makro.co.za.

40.    The Promoter accepts no liability for any further and or additional costs and/or expenses in relation to delivery of the prize, and the winner indemnifies the Promoters, its Directors, employees, shareholders and agents against any claim of whatsoever nature howsoever arising.  

41.    You enter the Competition entirely at their own risk. The Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, any participating store and/or its subsidiaries cannot be held responsible or liable for any accident, injury, harm or loss suffered by any person or entity as a direct or indirect result of entering the Competition or suffered as a direct or indirect result of the utilisation in any way whatsoever of the prize won in terms of the Competition.

42.    Competition artwork is for illustrative purposes only. Participants hereby agree to release and indemnify the Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors and subsidiaries and hold it harmless against any and all losses, harm, damages, rights, claims and actions of any kind in connection with the Competition, promotion or special offer or resulting from the participation in the Competition or acceptance, possession, use or receiving of any prize relating to the Competition, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.

43.    The Promoter and its service providers, are not responsible for:
43.1.    incorrect and inaccurate transcription of entry information;  
43.2.    technical malfunction; 
43.3.    inappropriate images and comments posted by the entry or by the public; 
43.4.    lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network or computer equipment or software; and/or 
43.5.    the inability to access any website or online services or any other error.

44.    This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other social media platform that may be used as an intermediary.
