TERMS AND CONDITIONS

  1. This mo’fresh mo’mentos 2025 campaign (“Campaign”) is organized by PVM South Africa with registered office in 2 Country Club Est, Woodlands Dr, Woodmead, Johannesburg, 2052 (“Organizer”).

  2. This Campaign begins on 1 October 2025 at 00:01am and ends on 15 December 2025 at 11:59pm (“Entry Period”). To be eligible for the Campaign entries must be received within the specified Entry Period. No entries outside of the campaign period will be accepted.

  3. Products: The participating products that can be used to enter this Campaign are listed below: (“Products”)

  1. Eligibility: The Campaign is open only to those who sign up/enter into participation and who are 18 years of age or older] as of their date of entry
  2. Participant(s)” are required to purchase any of the above-mentioned Mentos products, in a valid transaction at any participating store/s in the Republic of South Africa during the entry period/s.

  3. Organizer acknowledges that this campaign is in no way sponsored, endorsed, or administered by, or associated with Instagram/Facebook/TikTok, WhatsApp and releases Instagram/Facebook/TikTok, WhatsApp of any and all liability in relation to this Campaign. Any information provided by the Participant under this Campaign is provided to the Organizer and not to Instagram/Facebook /TikTok, WhatsApp. In accepting these terms and conditions Participants release Instagram/Facebook /TikTok, WhatsApp from any liability to the fullest extent possible in law.

  4. Organizer's employees, or employees of its affiliates, suppliers, partners, advertising and promotion agencies (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Campaign.

  5. Territory: This Campaign is only valid in the Territory of Republic of South Africa.

  6. Points of sale: This Campaign is valid in all points of sale located in the Territory where the participating products in Campaign are available and in stock.
  7. Purchase of Product: Participants must keep the original or copy receipt as proof of purchase.

  8. Agreement to Terms and Conditions/Rules: By entering this Campaign the Participant accepts and agrees to abide by this Terms and Conditions and Organizer’s decisions, which are fully and unconditionally binding in all respects. The Organizer reserves the right to refuse, withdraw, or disqualify any entry at any time at the Organizer’s sole discretion. By entering this Campaign, the Participant represents and warrants to be eligible to participate based on eligibility requirements explained these published rules. The Participant also agrees to accept the decisions of the Organizer as final and binding as it relates to the content of this Campaign.

  9. How to Enter:

    1. To participate, purchase any one or more of the participating products in one valid transaction at any participating retailer. Participating retailers include, but are not limited to: Shoprite, Checkers, Checkers Hyper, Pick n Pay, Pick n Pay Hyper, Spar, Clicks, Dis-Chem, Engen, Caltex, BP, Sasol, Total, Astron, Makro, Game, Ok and other Independent Retailers, Wholesalers, or Forecourts.
    2. This offer is subject to availability of participating products at the time of purchase.
    3. Enter by scanning the QR code on Point of Sale or sending “Fresh” to the WhatsApp line, 076 613 6829. WhatsApp rates are variable and as per participants’ network supplier pricing. If in a Wi-Fi zone/connection, then it’s a zero cost. Data charges may be applicable, and network charges are for the Participant’s own account.
    4. Participants must follow the prompts, accept the T&Cs, upload a valid till slip and complete the entry user journey to collect points for a chance to claim vouchers and gain a chance for entry into the grand prize draw at the end of the campaign period. Retain the original till slip for verification.
    5. Network charges may apply.
  10. Prizes include:

    1. Vouchers (as listed in 14.5 below) are redeemable against points collected by the participant. The total value of voucher available for redemption is equivalent to R200 000 (TWO HUNDRED THOUSAND RAND) over the campaign duration.
    2. Grand Prizes: Includes 1 (ONE) of 10 (TEN) R10 000 (TEN THOUSAND RAND) cash prizes to put towards a local shopping spree. The draw will take place within 30 (THIRTY) working day from the close of the competition.
    3. Total grand prize value to be given away is R100 000 (ONE HUNDRED THOUSAND RAND) over the competition period.
  11. mo’fresh mo’mentos competition voucher selection process:

    1. For every valid purchase of Mentos product(s) and per valid till slip upload, the participant will be allocated a specific number of points, see below:

    1. mo’fresh mo’mentos Competition participants are required to collect a minimum of 15 points to be able to claim an available voucher.
    2. Vouchers available for selection via the mo’fresh mo’mentos Competition WhatsApp bot are subject to availability and the promoter reserves the right at its discretion to update the selection available to a different voucher value and/or type of an equal commercial value during the campaign period.
    3. Should the participants claim a voucher against their available points, the accumulated points total will be reduced by the number of points used to claim the voucher. To earn more points, the participants will need to purchase more products.
    4. When a participant redeems their accumulated points to claim an available voucher, a unique digital voucher code will be sent via WhatsApp to the mobile number used to enter the campaign and linked to their account. The voucher code will be delivered within 48 (forty-eight) hours of the redemption request.”

  1. All vouchers & the grand prizes are non-transferable. The participant, upon claiming the voucher, is solely responsible for all expenses related to redeeming the voucher, including without limitation any and all applicable taxes. Vouchers are subject to voucher suppliers’ terms and conditions and expiry dates.
  2. Risk of prizes/vouchers pass upon delivery. Vouchers are only redeemable in South Africa.

  3. Grand Prize Winners selection: All 10 (TEN) grand prize finalists will be selected by random draws conducted by the Organizer at the end of the campaign period. The organiser reserves the right to select backup finalists in the event of a finalist not being able to accept the prize. All finalists will be subject to verification to be declared a final winner.

  4. Draw Dates: A random audited draw will take place within 30 (THIRTY) working day from the close of the competition. These dates are subject to change at the discretion of the organiser for reasons such as but not solely limited to operation needs, technical issues and/or insufficient entries.
  5. Winners notification and verification: Grand prize finalists will be contacted by Phone within 14 (FOURTEEN) working days following finalist/s selection and will be required to submit valid lawful documents and information such as copies of identity documents or proof of address not older than 3 months that includes full name, home address, an active phone/mobile number, and a verified copy of their personal identity document as well as verified proof of banking details to be declared a final Grand Prize Winner.

  6. If the finalists cannot be reached per telephone or email after 3 attempts in 3 days or cannot provide any confirmation within 3 (THREE) days to the Organizer after having been informed, such finalist will forfeit the chance to proceed further to be declared a final winner and the organisation reserves it right to move to the next finalist or backup finalist as drawn.

  7. The Organizer is not responsible for nor shall be held liable for finalists and/or Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam email. Nor shall be Organizer liable for the finalists and/or winner’s provision of incorrect or otherwise non-functioning contact information.
  8. If the winner 1) fails to claim the prize within 30 (THIRTY) days from the time of being declared a final winner as per the rules set out herein the prize notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an substitute finalist may be selected, subject to successful verification to be declared a winner.

  9. Receipt of the prize by the winner is upon the condition of compliance with this these terms and conditions and any and all applicable laws and regulations.

  10. Delivery of the prizes:

Grand prizes will be sent via electronic transfer by the Organizer (directly or through the agency or expedition company appointed by the Organizer for that purpose), to the verified banking details of the winners according to the information provided by the Participant to the Organizer following this terms and conditions. The Organizer will not be responsible for any error in the electronic transfer if it is due to the winners’ mistake.

  1. Photo Uploads

By submitting a photo, the Participant confirms that they own the photo and have consent from anyone featured in it. The photo must not contain unlawful, offensive, or inappropriate content. The Participant grants the Promoter a non-exclusive right to use the photo for Campaign purposes and accepts full responsibility for any third-party claims. The Promoter is not liable for any infringement or misuse, and the Participant indemnifies the Promoter against all related claims. Personal information will be processed in line with POPIA.

  1. The Participant grants the Organiser the right to use their uploaded photo(s), profile name, and the likeness of any individuals appearing in the photo(s), as well as any other content submitted as part of the Campaign, for purposes related to the Competition, including marketing and promotional use across print, digital, and social media platforms. No compensation will be payable for such use. Participants will be given the opportunity to decline publication of their image or participation in promotional materials.

  2. Personal Data Protection: In compliance with the applicable personal data protection laws, the Organizer informs the Participants that the personal data provided to participate in the Campaign will be collected and processed under the control of the Organizer solely for the purpose of operating this Campaign including the management of the Participant’s participation and, in its case, the delivery of the Prize and the publication of the Participant’s data as winner of a prize as indicated in this Terms and Conditions. Consequently, the processing of the Participant’s personal data is based on the Participant’s will to participate in the Campaign. Participants accept that the Promoter or its suppliers, agents who in some instances may reside outside the Republic of South Africa, may collect or Process Personal Information of Participants. By entering this Promotional Competition, each Participant hereby consents to the Processing of their Personal Information for the purposes of this Promotional Competition.

  3. The personal data processed will be kept as long as the Campaign is in force and after only for the publication purposes referred and/or as long as it is necessary to comply with any legal regulation that may impose the Organizer the obligation to keep the data for a longer period of time.
  4. The Organizer informs the Participant, that accepts, that it may outsource to third parties part of the services related to the management of the Campaign with the purpose to obtaining logistic and/or administrative support (for instance, companies that carry out the service of delivering the prizes, or companies rendering technological services like hosting of the Organizer’s Website or social media channels). All these companies are acting as processors or authorized recipients and can have access to and/or process the Participant’s personal data only as far as it is necessary to comply with the purposes of this Campaign.
  5. The Organizer informs the Participant that he/she has right to request access to and rectification or erasure of his/her personal data, or restriction or objection to processing, as well as the right to data portability or to withdraw the consent given by addressing to the Organizer by sending an email pvmdpo@it.pvmgrp.com always providing a copy of the identification document or any other document proving it.
  6. Organizer reserves the right to verify the truthfulness of the personal data provided by the Participant at any time.

  7. Organizer's decision on the winner cannot be contested.

  9. Campaign advertising: The advertising of this campaign will be made on point of sale and/or on social channels that the Organizer deems appropriate.
  10. Use of an automated system to participate is prohibited and will result in disqualification. The Organizer has the right, at its absolute discretion, to disqualify the winner if the Participant's acts to participate or information provided does not comply with the rules and regulations of the competition. The Organizer shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims and entries including, without limitation, to require further verification as to the identity, age and other relevant details of a Participant and before accepting a claim or entry as being valid.

  11. The Organizer reserves the rights to vary these Terms and Conditions or cancel the Campaign at any stage in the event of circumstances arising beyond its control. Any change shall be advertised in the same way this Campaign has been advertised.

  12. In its sole discretion, the Organizer reserves the right to modify, suspend, cancel, or terminate the Campaign should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Organizer’s control, impact or corrupt the security, fairness, proper conduct, or administration of Campaign. The Organizer, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Organizer. Individuals who tamper with or attempt to tamper with the operation or entry process of the Campaign or website or violates these Terms & Conditions will be disqualified by the Organizer in its sole discretion. In its sole discretion, the Organizer has the right to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: [identify any disallowed entry methods that will result in votes/entries being voided; examples: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the Campaign rules; or the use of bots, macros, scripts, or other technical means for entering.] Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. If any such attempt is made, the Organizer reserves the right to seek damages to the fullest extent permitted by law.
  13. Limitation of Liability: Entry into this Campaign constitutes Participant’s agreement to release and hold harmless the Organizer and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Campaign and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

  14. Other conditions and considerations

    1. Entries will be considered by the order in which they were submitted via WhatsApp and their validation.
    2. The Organizer will not be responsible for any problem that occurs with the Internet connection used to send entries.
    3. The Organiser will not be responsible for any loss, damage or unavailability or participating products at affiliated points of sale at participating retailers.
  15. Applicable law: This Campaign is governed by the laws of Republic of South Africa.
